Why is MPS now developing its own General Terms and Conditions and a Data Policy?
Until now, the General Terms and Conditions of MPS-ECAS applied to most agreements. This was down to the division of roles within the MPS Group: MPS-ECAS is responsible for audits and certification, while Stichting MPS focuses on developing and managing certification standards and digital tools to boost sustainability in the industry.
MPS has seen its role expand significantly in recent years. In line with our ambition to drive sustainability and serve as an industry data specialist in the industry, MPS has now established its own General Terms and Conditions and a supplementary Data Policy.
What are General Terms and Conditions?
General Terms and Conditions are a set of agreements that accompany a contract. They lay down arrangements with regard to payment, delivery, liability, pricing and more.What are the MPS General Terms and Conditions?
The MPS General Terms and Conditions include provision on:the formation and termination of contracts;
payment terms and liability;
ownership and usage rights of data and tools;
complaints procedures and applicable law;
force majeure and rights and obligations in unforeseen circumstances;

What is the MPS Data Policy?
The Data Policy outlines how MPS handles customer data, group data, and general data. Our Data Policy is based on the following principles:control and data sovereignty: what rights do you have regarding your data;
transparency: what data does MPS collect and for what purpose;
purpose limitation: the purposes for which MPS may use your data;
confidentiality and security: how your data is protected;
data portability and interoperability: how and in what format data is made available;
use of external data systems: agreements regarding data provided by third parties.
Why do I need to accept the General Terms and Conditions and the Data Policy?
Our products and services will remain unchanged, but the rights and obligations associated with the delivery of our products and services have now been described in greater detail. By accepting the T&Cs, you agree to these terms, avoiding any misunderstandings.
What happens if I do not accept the General Terms and Conditions and the Data Policy?
By accepting, you agree to the terms linked to our products and services. If you do not accept them, we cannot continue our business relationship and will no longer be able to provide our products and services to you. However, this does not release you from your payment obligations.
What is changing?
Our products and services will remain unchanged. The MPS General Terms and Conditions and the Data Policy now describe the rights and obligations associated with the delivery of our products and services in greater detail and clarity.
